ENVI 317(F) Environmental Law (Same as Political Science 317)

An introduction to the basics of law and legal reasoning in the environmental context. The course begins with an examination of the historical common law theories of pollution including nuisance and trespass, then explores a renewed federal environmental "presence" under the National Environmental Policy Act of 1969 and similar procedural statutes. The remainder of the course concentrates on a number of important substantive state and federal environmental laws including the public trust doctrine, the endangered species act and the "takings" questions under the 5th A. Evaluation will be based on a final exam, graded written case briefings and written research exercises. Enrollment limited to juniors and seniors.
